your unique style and needs. IBM Australia is currently looking for an Employment Legal Counsel to join our in-house team. The role is responsible for leading the employment law function and accountability across ANZ operations. This involves servicing the different lines of business including the senior leadership team and executive HR leads. In this role, legal support is provided in relation to non-contentious and contentious work across all aspects of employment and industrial laws together with audit and compliance. Key responsibilities / accountabilities include: • Legal advice and approval of non-standard onboarding of candidates, typically around issues of prior intellectual property and conflicts of interest and post-employment obligations to previous employers; • Legal advice on ANZ and Global projects having a HR element from changes to compensation and benefits, HR policies and processes, workforce management, review of terms and conditions of employment and organisational change; • Legal advice and support to the internal HR case management team who manage complex matters and internal investigations to minimise legal risk and liability and to deal with any external legal correspondence; • Legal advice to the business and HR Business Partners on various HR issues including separation of senior personnel and complex separations, performance management and compliance with policies and procedures; • Legal advice and support to Internal Audit around compliance with company policies and requirements, including advice and support on implementation of recommendations; • Responding to and coordinating responses to any external regulators, as appropriate; • Appear and represent the company at employment commissions and tribunals pre-commencement of court or tribunal proceedings; • Briefing and instructing external counsel on litigated employment matters; • Legal advice on employment and industrial issues arising from outsourcing and insourcing projects, including advice on legal and commercial risks of HR terms, dealing with employee organisations and on privacy and data protection. Required: • Current practising certificate, NSW or other Australian state. • Strong academic background, post graduate study considered favourably. • Experience in major law firm including secondments to corporates or a mix of law firm and in-house experience. • Strong commercial negotiation and drafting skills. • IT services contracting experience required. • Needs to be a strong team player and capable of working unsupervised. • Dynamic, enthusiastic personality. • Capable of building strong relationships with the business IBM has always been committed first and foremost to its people.
